TrackPoint Copyright Policy

TrackPoint Technologies Inc. ("TrackPoint," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy describes ownership of content on our AI roleplay training platform (the "Services") and our procedure for handling claims of copyright infringement.

Source Material Used to Build Training Modules

Organizations build training using their materials: playbooks, policies, case notes, call transcripts and similar content uploaded to the Services, as well as content brought in through a connected integration.

  • Source material remains the Customer's own content, or their Organization's. TrackPoint claims no ownership of it and does not reuse it outside that Organization.
  • The Customer is responsible for holding the rights to any material they upload or connect, and for ensuring their licence permits this use.
  • Training content licensed from a vendor, published curricula, third-party methodologies and assessment instruments frequently carry licences that do not extend to use on a platform of this kind. These should be reviewed before upload.
  • The notice-and-takedown process below applies to uploaded and connected source material exactly as it applies to any other content on the Services.

AI-Generated Content

The Services generate training module content, roleplay dialogue, rubrics and written feedback.

  • As between TrackPoint and the Customer, generated content produced for an Organization may be used by that Organization for its own internal training and assessment, both during the subscription term and afterwards.
  • Generated content may not be resold, published as a standalone product, or embedded in a competing product. See our Terms and Conditions.
  • Generated content is produced from the Customer's own source material and the prompts given to it. Similar inputs may produce similar outputs for different customers, and we make no claim of exclusivity in generated content.
  • Copyright in AI-generated material is unsettled in many jurisdictions. Nothing in this policy is a representation that generated content is protected by copyright.

Reporting a Claim of Copyright Infringement

If you are a copyright owner or an agent thereof and believe content on the Services infringes your copyright, you may submit a notification of claimed infringement ("Notice") to our Copyright Agent. Your Notice must be in writing and include the following:

• Identification of the copyrighted work you claim has been infringed.

• Identification of the allegedly infringing material, with information reasonably sufficient to permit us to locate it, such as a URL, training module name or organization name.

• Your contact information, including your name, address, telephone number and email address.

• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

• Your physical or electronic signature.

Our Response to a Notice

Upon receipt of a valid Notice, we will take whatever action we deem appropriate, which may include promptly removing or disabling access to the allegedly infringing material. We will notify the user who posted the material and, where the material sits within an Organization, that Organization's administrator, and provide an opportunity to respond.

Counter-Notification

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may send a counter-notification to our Copyright Agent. The counter-notification must include:

• Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or disabled.

• Your contact information, including your name, address, telephone number and email address.

• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

• A statement that you consent to the jurisdiction of the Federal Court of Canada and that you will accept service of process from the person who provided the original Notice.

• Your physical or electronic signature.

Repeat Infringers

We will terminate the accounts of users determined to be repeat infringers. Where a repeat infringer is a Learner within an Organization, we will notify that Organization's administrator.

Changes to This Copyright Policy

TrackPoint reserves the right to modify this Copyright Policy at any time. The updated policy will be posted on our website, and your continued use of the Services after such changes constitutes acceptance of the new policy.
