TrackPoint Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the TrackPoint website, AI roleplay training platform and related services (the "Services"). By using the Services you agree to this AUP and our Terms and Conditions. Violations may result in suspension or termination of your account at our sole discretion.
Prohibited Activities
You agree not to use, or encourage or facilitate others to use, the Services for any of the following activities:
Illegal and Harmful Activities
Engaging in, promoting, or facilitating any illegal activity or violating any applicable local, provincial, national, or international law or regulation.
Harmful and Abusive Content
Uploading, sharing, or transmitting any content that is unlawful, defamatory, obscene, abusive, harassing, threatening, or otherwise objectionable.
Intellectual Property Infringement
Violating the intellectual property rights of others. This includes uploading source material your organization does not hold the rights to, and any content that infringes copyrights, trademarks, patents, or trade secrets. Licensed training content and published curricula frequently carry licences that do not extend to this use.
Misrepresentation and Impersonation
Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity. This includes completing an assessment on behalf of another learner, or permitting another person to complete one on your behalf.
Misuse of Connected Integrations
Connecting an account you are not authorized to connect. Using an integration to collect or infer information about third parties beyond generating your own practice scenarios. Attempting to reach another learner's connected data.
Recording and Consent
Practising with material that features other people without their consent. You may only record yourself, and you must hold the necessary permissions for any voice, image, or likeness of another person that appears in what you upload, consistent with our Terms and Conditions.
Concurrent Seat Sharing
Sharing your credentials or letting another person work under your seat at the same time as you. Administrators can reassign a seat to a different learner whenever they need to, but a seat covers one named person at a time, because scores and completion history are attributed to whoever generated them.
Security Violations
Attempting to compromise the security or integrity of our Services, systems, or networks. This includes probing, scanning, or testing vulnerabilities, or attempting to gain unauthorized access to accounts, organizations, or data that is not yours. Suspected vulnerabilities should be reported to us rather than tested.
Service Disruption
Interfering with or disrupting the normal operation of the Services. This includes denial-of-service attacks, distributing malware, or any activity that places an unreasonable load on our infrastructure.
Unauthorized Automated Use
Using automated scripts, bots, spiders, or other data gathering methods to access or use the Services without our express written permission.
Reverse Engineering
Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code or underlying models of the TrackPoint platform.
Unauthorized Commercial Use
Reselling the Services, embedding them in a competing product, or republishing generated content as a standalone product, without our express written consent.
Misuse of AI Features
Deliberately manipulating the AI to generate inappropriate, biased, or harmful output, or to produce content unrelated to training and assessment.
Export Control and Sanctions Compliance
You agree to comply with all applicable export control laws and economic sanctions. You may not use the Services if you are located in, or a resident of, any jurisdiction where such use would be prohibited by law or regulation.
Organization Responsibilities
Where a company or institution purchases access, that Customer is responsible for its Learners' compliance with this AUP. In particular, an Organization is responsible for:
- ensuring it holds the rights to any source material it uploads or connects in order to build training modules;
- informing its Learners that practice sessions are recorded and scored, and how results will be used;
- allocating seats to named individuals and reclaiming them when people leave;
- any decision it makes on the basis of a score, including any human review that decision requires.
Monitoring and Enforcement
We do not actively monitor user content, but we reserve the right to investigate suspected violations of this AUP. If we become aware of a violation, we may take any action we deem appropriate, including:
- Issuing a formal warning.
- Removing prohibited content.
- Suspending or terminating access to the Services.
- Notifying the relevant organization administrator.
- Reporting the activity to law enforcement or other appropriate third parties.

Changes to This AUP
We reserve the right to modify this AUP at any time. Changes are effective immediately upon posting the updated AUP on our website. Your continued use of the Services after changes are posted constitutes acceptance of the revised policy.
